JURISDIÇÃO CONSTITUCIONAL: CONTRIBUIÇÃO DO JUDICIÁRIO PARA FORTALECIMENTO DE DEMOCRACIAS EM PROCESSO DE CONSOLIDAÇÃO

Resumo: O fenômeno da expansão do poder judicial pode ser observado a nível global. O fato social da judicialização da política, como fenômeno que surge no contexto do Estado Constitucional, compele o Poder Judiciário a assumir um papel de protagonismo inclusive no campo político, cujo desempenho responsável e independente, especialmente nos países em desenvolvimento, constitui etapa fundamental do que pode ser considerado um processo em direção ao fortalecimento da democracia, e que tem como objetivo final a consolidação democrática, ainda não alcançada entre nós.  Por outro lado, em países cuja democracia encontra-se plenamente consolidada, observa-se uma autocontenção do Poder Judiciário.

Abstract: The expansion of the judicial power phenomenon can be noted at a global level.  The social fact of the judicialization of politics as phenomenon arising in the constitucional state scenario compel the Judiciary to take on the role (including political) on a responsible and independent matter (specially in developing countries).  It constitutes a fundamental step in a process towards democracy strengthening and it has the final objective of the still not attained democratic consolidation. On the other hand, we have seen a self-restraint of Judiciary Branch in countries that already achieved democratic consolidation.
