Resumo

THE MARRIAGE FOR GAY AND TRASGENDER PEOPLE

RESUMEN: Este breve comentario se refiere a la regulación del matrimonio de las personas transexuales y homosexuales en el derecho europeo y en el derecho español. En ambos ordenamientos la creación de una familia es un derecho diferente al derecho a casarse. La familia y el matrimonio deben articularse a partir de la dignidad, la libertad y la igualdad de las personas.

ABSTRACT: This paper concerns the regulation of marriage for gay and transgender people in European law and Spanish law. In both orders the creation of a family is a different right to the right to marry. The family and marriage should be articulated from the dignity, freedom and equality of persons.
