ENVIRONMENTAL CONSTITUTIONAL LAW AND SYSTEMATIC INTERPRETATION: A LEGAL AND CONSTITUTIONAL PROTECTION FOR THE BALANCED ENVIRONMENT

RESUMO: O trabalho se propõe a analisar a interpretação dada ao artigo 225, caput, § 1º, inciso VII da Constituição Federal a partir de um caso julgado pelo Supremo Tribunal Federal na perspectiva do chamado direito constitucional ambiental e a nova hermenêutica, evidenciando o caráter meta individual do objeto de proteção bem como a tutela jurídica autônoma que lhe é atribuída.

PALAVRAS-CHAVE: meio ambiente; proteção constitucional; interpretação sistemática.

ABSTRACT:  This article aims at analyzing the Supreme Court interpretation of the Article 225, caput, § 1., Section VII of the Federal Constitution, related to the so-called environmental constitutional law and the new hermeneutic, to show the “meta individual” character concerns both to the object of protection and the autonomous legal protection.
