O direito social fundamental à saúde e seu tratamento frente ao postulado da reserva do possível

Resumo

Esta pesquisa tem como escopo o estudo da concretização do direito à saúde perante o Poder Judiciário, especialmente diante do diálogo entre a garantia do mínimo existencial e o postulado da reserva do possível, como institutos aparentemente antagônicos diante de situações como a que se alveja neste texto. A importância do tema é gritante, tendo em vista as inúmeras ações propostas objetivando a realização do direito social fundamental à saúde. É nesse mote que se avaliará o modo como tal faculdade jusfundamental é aplicada nos casos concretos, mediando-se as condições de sua concretização e a legitimação do Poder Judiciário, em razão da omissão do próprio Estado, para tal atividade. Metodologicamente, a pesquisa se pautará no estudo doutrinário e jurisprudencial sobre o tema. Ao cabo, a meta é esclarecer o modo como o direito social fundamental à saúde é efetivado no Brasil, sob o crivo do Poder Judiciário.

ABSTRACT: The following research has as objective the study of the concretization of the right to health in the Judiciary Power, specially the dialogue between the assurance of the subsistence level and the realms of possibility, as apparently antagonistic entities in situations such as the analysed in this text. The importance of the subject is wondrous, considering the many lawsuit whose goal is the completion of the fundamental social right to health. In this sense, will be evaluated the application of this fundamental faculty in concrete cases, measuring the conditions to its completion and the legitimation of the Judiciary Power due to omission from the State to its completion. Methodologically, this research is based on doctrine and jurisprudence around the subject. Finally, the goal is to clarify the way the fundamental social right to health is applied in Brazil, according to the Judiciary System.
