O acesso à saúde nas fronteiras do Mercosul: entre as normas e a realidade

Resumo

Por meio da presente pesquisa, de caráteres bibliográfico e investigativo, busca-se questionar, bem como aguçar, o debates sobre a saúde enquanto direitos humanos e as consequentes obrigações do Estado, abordando um tema específico e que diz respeito à integração no Mercosul: a questão da saúde nas fronteiras. Tal qual se pretende abordar a questão, objetiva-se trazer questionamentos sobre a indispensabilidade de uma abordagem social à integração no Mercosul, bem como uma análise da efetividade do direito de acesso à saúde. Tendo em vista que a saúde é um direito constitucionalmente garantido a todos e um dever do Estado brasileiro, faz-se necessário indagar sobre a plenitude, ou o alcance, de seu acesso universal e igualitário à população de estrangeiros residentes nas cidades de fronteira do Mercosul.

ABSTRACT: Through this bibliographical and investigative research, we sought to challenge and sharpen the debate on Human Rights and obligations of the state, addressing a specific theme which concerns to integration in Mercosur: the issue of the access to health at the border. This question, in the manner that the paper will seek to address, raises questions about the indispensability of an approach to social integration in Mercosur, as well as an analysis of the effectiveness of the right of access to healthcare. Since health is a constitutionally guaranteed right to all and a duty of the Brazilian state, it is necessary to inquire about the fullness, or extent, of its universal and equal access to the population of foreign residents in the border towns of Mercosur.
