Cabimento da ação de responsabilidade civil por abandono afetivo parental

Resumo

A evolução da sociedade exigiu o reconhecimento jurídico de novas formas de convívio familiar, nas quais o centro da proteção jurídica prioriza os elos de afetividade e tem como princípio maior a dignidade da pessoa humana. Com o despontar das famílias plurais, houve o aumento crescente das dissoluções conjugais e, consequentemente, surgiu a figura dos filhos resultantes de famílias desfeitas e, na maioria dos casos, privados da convivência de um dos pais. Não é incomum que o genitor forme nova família e entenda ser suficiente atender às necessidades materiais dos filhos do relacionamento anterior, rompendo bruscamente os laços afetivos e causando sérios danos psicológicos às crianças. Na legislação brasileira não há, textualmente, norma que tutele os direitos das crianças e dos adolescentes que sofrem o abandono afetivo parental, mas já surgiram nos Tribunais ações de filhos em face de seus genitores, buscando a reparação pelo dano moral decorrente do abandono afetivo. O assunto é novo e as opiniões doutrinárias e jurisprudenciais são controversas. Este trabalho tem por objetivo verificar se a ação de responsabilidade civil por abandono afetivo parental é cabível.

ABSTRACT: The evolution of society demanded legal recognition of new forms of family life, in which the center of legal protection prioritizes the bonds of affection and is the major principle of human dignity. With the emergence of plural families there was increasing dilutions of marital and consequently emerged the figure of the children from families resulting undone, and in most cases the private interaction of a parent. It is not uncommon for the parent form and understand new family be enough to meet the material needs of children from previous relationship, breaking sharply affective bonds and causing serious psychological harm to children. Brazilian law there is, literally, rule that protects the rights of children and teenagers who suffer from affective parental abandonment, but already appeared in court actions in the face of children from their parents, seeking compensation for moral damages resulting from emotional abandonment. The subject is new and the doctrinal and jurisprudential opinions are controversial. This study aims to determine whether the action of civil liability for abandonment is parental affective measures.
