O cenário internacional de um direito fundamental: A democracia e a crise econômica

Resumo

O presente artigo tem por tema o direito fundamental à democracia e suas relações com a economia, em tempos de crise financeira mundializada. O problema gira em torno de saber se é possível a efetivação dos direitos fundamentais de quaisquer gerações num ambiente de ausência de democracia, localizada esta como uma espécie de “direito fundamental condição” ou “direito fundamental pressuposto”. A hipótese central é que a crise econômica vem mostrando os limites do modo capitalista de produção para promover a efetividade dos direitos fundamentais, embora eles sejam metas traçadas dentro dos marcos políticos e ideológicos deste sistema, exatamente porque a crise tem abalado os pressupostos de uma democracia política e econômica possível. O tema justifica-se na medida em que vivemos a maior crise econômica depois de 1929, objetivando-se, com isso, prever situações e blindar a democracia brasileira contra desacumulações democráticas derivadas de fatores econômicos. Para tanto, partindo do referencial teórico da filosofia da práxis e de um método indutivo, buscar-se-á colher elementos concretos que possam colaborar na construção de um pensamento sobre a temática, contribuindo para a construção das instituições democráticas brasileiras e a efetivação dos direitos fundamentais.

ABSTRACT: The theme of this article is the fundamental right to democracy and its relations with the private sphere, in times of economic crisis. The issue revolves around whether it is possible the realization of fundamental rights of all generations in an environment of lack of democracy, is located as a kind of “fundamental right condition” or “fundamental right assumption”. The central hypothesis is that the economic crisis has shown the limits of the capitalist system to promote the effectiveness of fundamental rights, though they are targets set within the frameworks of this political and ideological system, precisely because the crisis has shaken the assumptions of a political democracy and economically as possible. The theme is justified insofar as we live in the greatest economic crisis after 1929, aiming to thereby provide shielding situations and Brazilian democracy against democratic returns derived from economic factors. For this purpose, considering the theoretical philosophy of praxis and an inductive method, seeking will reap concrete elements that can assist in building a thought on the subject, helping to build democratic institutions in Brazil and the enforcement of fundamental rights.
