A disciplina dos agravos no projeto do novo Código de Processo Civil

Resumo

O presente trabalho tem por finalidade analisar o projeto de lei atualmemte em tramitação no Congresso Nacional (Substitutivo da Câmara dos Deputados nº 166/2010) que pretende a edição de um novo Código de Processo Civil, fazendo um comparativo com a ordem atual e a sistemática proposta para a impugnação de decisões interlocutórias nos juízos de primeira instância e nos Tribunais – a disciplina dos agravos atual e projetada. Abordar-se-á as inovações apresentadas, como a extinção do agravo regimental e o sistema de preclusões, as alterações nas hipóteses de cabimento e processamento do agravo de instrumento, a regulamentação da impugnação das decisões monocráticas nos Tribunais por meio do agravo interno e a criação do agravo extraordinário em sede de recursos especial e extraordinário, ponderando, por fim, o impacto e os reflexos do novo CPC para a celeridade e efetividade do processo, exigências da sociedade pós-moderna do século XXI.

ABSTRACT: This study aims to analyze the project law pending in Congress (Substitute House of Representatives nº 166/2010) which aims to issue a new Code of Civil Procedure, making a comparison with the current order and the systematic proposal for the the appeal of interlocutory decisions in the lower courts and in the courts – the current and projected discipline of motions. Innovations presented, as the extinction of the retained motion of the system and debarments, changes in assumptions and processing of the appropriateness of an instrument motion, challenging the regulation of monocratic court decisions through internal motion and will address up-creation of extraordinary motion in seat features special and extraordinary, pondering, finally, the impact and the consequences of the new CPC for the speed and effectiveness of the process requirements of the postmodern society of XXI century.
