THE LEGAL HERMENEUTICS AND BRAIN SCIENCE: HOW TO DEAL WITH THE MENTAL AUTOMATISMS

RESUMO: A teoria da interpretação jurídica tem de inovadoramente incorporar o exame dos vieses (biases) cientificamente mapeados. Conhecer tais automatismos mentais, substituindo-os, quando cabível, por hábitos reflexivos, é a proposta central do presente paper.

ABSTRACT: The theory of legal interpretation must innovatively deal with biases (biases) of our brains, scientifically mapped. Knowing such errors derived from automation, and replacing them with reflective habits of mind, is the central aim of this paper.
