Neoconstitucionalismo e a (re)significação dos direitos humanos fundamentais

Resumo

Inegável é a importância dos direitos humanos fundamentais na modernidade e que deve ser entendido a partir do papel transformador que exerce. Partindo-se da referida análise, o direito constitucional contemporâneo não deve ser entendido ou interpretado mediante a existência de normas que, pura e simplesmente, devem ser interpretadas e aplicadas pelo juiz ou pelo jurista, pelo contrário: o direito constitucional da modernidade deve ser entendido como um direito em constante transformação, em que as suas normas e princípios – progressivamente – são interpretados e reinterpretados de forma a se garantir a máxima efetividade na proteção da pessoa humana. Concretamente tem-se aqui o conceito de neoconstitucionalismo como elemento de ressignificação dos direitos humanos fundamentais. Também inegável reconhecer-se a importância do direito internacional dos direitos humanos após a Segunda Guerra Mundial, para a construção dos direitos humanos e a inserção nos ordenamentos constitucionais dos Estados contemporâneos.

ABSTRACT: Undeniable is the importance of fundamental human rights in the modernity. The human rights must be understood from its transformative role it plays. Starting from these analysis, the contemporary constitutional law should not be understood or interpreted by the existence of standards that simply must be interpreted and applied by the judge or jurist, but the modern constitutional law must be understood as a right in constant transformation, where its rules and principles – progressively – are interpreted and reinterpreted in order to ensure maximum effectiveness in the protection of the human person . Specifically it has been here the concept of reframing neoconstitutionalism as part of fundamental human rights. Undeniable also recognize the importance of international human rights law after the Second World War, for the construction of human rights and inclusion in the constitutional frameworks of contemporary states.
