A eficácia horizontal dos direitos fundamentais na teoria de Robert Alexy

Resumo

Este artigo tem por objetivos reconstruir a análise e a interpretação de Robert Alexy das teorias existentes na doutrina e jurisprudência constitucionais alemãs sobre a eficácia horizontal – teoria da eficácia direta, teoria da eficácia indireta e teoria da imputação – e descrever os elementos essenciais da teoria integradora e unitária que ele propõe. Alexy argumenta que as teorias existentes produzem resultados equivalentes, que cada uma delas toca em aspectos relevantes do problema e que por isso nenhuma delas pode ser considerada integralmente falsa ou integralmente correta. Tomando esses argumentos como pontos de partida, Alexy formula uma teoria integradora e unitária com a pretensão de satisfazer o postulado da correção na solução de cada caso concreto e com a pretensão de contribuir para uma compreensão mais precisa dos efeitos dos direitos fundamentais e das normas de direitos fundamentais no sistema jurídico.

ABSTRACT: This article aims at reconstructing Robert Alexy’s analysis and interpretation of the existing theories on German case law and legal literature about the horizontal effect – theory of direct effect, theory of indirect effect and theory of imputation – and at describing the essential elements of the integrative and unitary theory which he proposes. Alexy argues that the existing theories produce equivalent results, that each one of them deals with relevant aspects of the problem and therefore none may be considered entirely false. Using these arguments as a starting point, Alexy formulates an integrative and unitary theory with the purpose of satisfying the postulate of the propriety in the solution of every concrete case and with the purpose of contributing for a more precise understanding of fundamental rights and fundamental rights norms in the legal system.
