O perfil do Juiz na tradição ocidental

Resumo

O presente artigo busca afirmar conceitos fundamentais, bem como explicitar premissas de pensamento, a fim de refletir sobre as condições de possibilidade de debate sobre um perfil de juiz no Brasil, com referência à tradição ocidental. Nesse sentido, o expediente argumentativo foca na estrutura estatal em ordem decrescente da entidade e dos órgãos, isto é, parte-se do Estado Constitucional de Direito, passa-se pelo Pode Judiciário concebível no bojo do Estado Constitucional; enfim, se coloca a discussão sobre a judicatura como corpo profissional. Em movimento conclusivo, espera-se traçar breves paralelos com a experiência brasileira para se pensar a presente investigação como contributo para literatura jurídica sobre a Magistratura.

ABSTRACT: The present article seeks to affirm fundamental concepts, as so to explicit premises of thought, in order to ponder about the possibility conditions of debate about a judge’s profile in Brazil, with reference to the occidental tradition. In this sense, the argumentative itinerary focus on the state structure in decreasing order of the entity and the agencies, i.e., it starts on the Constitutional State-Law, goes through the Judiciary Power conceivable in the Constitutional State, and ends in the discussion of the Judicature as a professional body. In conclusive movement, it is expected to outline brief parallels with the Brazilian experience for the sake of thinking about the present investigation as contribute to the juridical literature devote to the Magistracy.
